Paris – A rare event in the court annals, the Criminal Court of Paris moves Friday in Seine-et-Marne, on the scene of the sabotage of a line SNCF for which members of the group of Tarnac are persecuted.
The court wants to check the coherence of a central part of the indictment: a report on a revolving Julien Coupat and his ex-comrade Yildune Levy, who was executed by anti-terrorists and intelligence agents during the night of 7 to 8 November 2008, where the sabotage of a TGV east line was committed.
The pair is being persecuted for having made these deteriorations by attaching a hook to the power line that has damaged the pantograph of a train heading towards Strasbourg.
" The court considered this transport to be useful for the manifestation of the truth ," President Corinne Goetzmann had justified when she followed a defense motion denouncing a document riddled with disagreements.
The prosecutor's office did not turn against it, considering that this shift will allow " to see that the observations made by the police are genuine ".
Thus, a whole court in the Seine-et-Marne area will move: four judges, two civil servants, two prosecutors, accompanied by a public prosecutor responsible for communications, the two SNCF civil party lawyers, the eight defendants and their four Lawyers. All will arrive at the courthouse early in the afternoon to arrange for their return before midnight.
On the spot, they will find five anti-terrorist police (SDAT) involved in the spinning mill.
" This is not a reconstruction, but a yard transport ," said the magistrate, noting that all the rules of the process are applied such as respect for the public debates.
For this reason, five journalists and ten representatives of the public will travel.
In places where the police report is contentious, six stops are planned.
The court will first proceed to the foot of the Marne Bridge in the municipality of Trilport, where the vehicle was stopped by Coupat-Levy.
PVC hoses that may have been used to attach a hook to the SNCF line and which the prosecution had bought the previous day from the couple in a hardware store following an interruption of their surveillance had flown into the river 16 months later.
Yildune Levy's attorney Marie Dosé found this discovery contradictory in a river that has experienced five flooding, dredging and cleanup operations since November 8, 2008.
The course ends at the scene of sabotage, where the police claim at 4:05 pm the couple's Mercedes vehicle " sited all the lights at the entrance of a service road " of SNCF, below where the hook is discovered. On the other hand, they say they saw no sabotage.
A version that challenges the defense after the pair had already returned to Paris, as evidenced by a blue card Yildune Levy withdrawal near Pigalle at 02:44.
" The investigators were opposed to the claims of the defense site," said Wednesday the former anti-terrorism commissioner Fabrice Gardon, even though he acknowledges " approximations ". The police officer recalled that the couple had not denied his presence on the scene until 4:00 pm, before the discovery of the Blue Card statement. " We believe someone else made this retreat "he said.
" It will be useful for the court to see the inconsistency of what some investigators claim, especially when they say they saw Coupat's car at the end of the trail but claim that he was unable to see with a light amplifier a person running on the tracks with a headlamp screwed in "explains Jean-Christophe Tymoczko, attorney Yildune Levy.
" If this move is made under normal conditions, the court will realize that the police have not stopped lying "said Jérémie Assous, Coupat's lawyer, who hopes for something other than hope reenactment from 2011 where everyone left with his affirmations.
